    Terms and Conditions

    These Terms & Conditions (“Terms”) govern your access and use of SWITCH (“we,” “our,” “us”), including our mobile application, website, and related services (collectively, the “Platform”). By registering, accessing, or using the Platform, you (“User,” “Buyer,” or “Seller”) agree to be bound by these Terms.

    If you do not agree, please do not use the Platform.

    1. Definitions

    • “User” – Any person who accesses or uses the Platform.

    • “Seller” – A User who lists and sells products on the Platform.

    • “Buyer” – A User who purchases products listed on the Platform.

    • “Product” – Any genuine, pre-owned, or new item listed for sale.

    • “Service” – The features, tools, and functionalities provided by the Platform.

    2. Eligibility

    • Users must be at least 18 years old to use the Platform.

    • By creating an account, you confirm that the information provided is true, accurate, and complete.

    • The Platform reserves the right to suspend or terminate accounts that provide false or misleading information.

    3. User Responsibilities

    • Users must maintain the confidentiality of their account credentials.

    • Users are fully responsible for all activities under their account.

    • Misuse of the Platform (fraud, fake listings, harassment, spamming, or illegal activity) will result in suspension or permanent ban.

    4. Seller Terms

    • Sellers must list only genuine and authentic products.

    • Product descriptions, photos, and conditions must be accurate.

    • Counterfeit, stolen, or prohibited items are strictly forbidden.

    • The Platform reserves the right to reject, edit, or remove listings that violate policies.

    • Once an order is shipped, Sellers cannot cancel it.

    • Payments to Sellers will be released only after Buyer confirms delivery and satisfaction (or as per Platform dispute resolution).

    5. Buyer Terms

    • Buyers must provide accurate shipping and contact details.

    • Payments must be made through the Platform’s secure payment gateways.

    • Buyers must confirm product delivery promptly upon receipt.

    • Returns or cancellations must comply with the Returns & Cancellations Policy (Section 8).



    6. Payments

    • All payments are processed through trusted third-party gateways (e.g., Razorpay, PayU).

    • The Platform does not store payment details.

    • Payment settlements to Sellers will be made after deducting applicable fees, shipping costs (if applicable), and charges.

    GST & Tax Policy

    • Role of SWITCH
       SWITCH acts solely as an intermediary platform connecting buyers and sellers for the sale of pre-loved fashion items. SWITCH does not own or sell any of the products listed on the platform.

    • GST on SWITCH Fees
       a. SWITCH charges a service/commission fee on every successful sale.
       b. Applicable Goods and Services Tax (GST) at the prevailing rate (currently 18%) will be charged on this fee.
       c. The GST on SWITCH’s service/commission fee shall be borne by the seller.

    • TCS (Tax Collected at Source)
       a. As per Section 52 of the Central Goods and Services Tax Act, 2017, SWITCH will collect 1% TCS (0.5% CGST + 0.5% SGST) on the net value of taxable supplies made through the platform.
       b. The TCS amount will be deducted from the seller’s payout and deposited with the Government of India.
       c. The TCS collected will be reflected in the seller’s GST account (if the seller is GST-registered).

    • GST on Product Sales
       a. Individual sellers who are not registered under GST are not required to charge GST on the sale of their pre-owned goods.
       b. Business sellers or thrift stores that are GST-registered must comply with all GST obligations on their product sales, including invoicing and tax remittance.

    • Buyer Payments
       a. The price displayed to buyers includes all applicable charges for the product.
       b. Buyers are not responsible for any additional GST or TCS beyond the listed price.

    • Payouts to Sellers
       After deducting SWITCH’s service/commission fee (including GST) and TCS, the remaining amount will be transferred to the seller’s registered payment account.

    • Seller Responsibility
       Sellers are solely responsible for their individual tax liabilities, including GST registration, reporting, and filing obligations (if applicable).

    Additional Notes

    • GST (18%) will be applied only on SWITCH’s commission fee, not the product price.
       Example: For a ₹5,000 sale → commission ₹500 → GST ₹90 → total deduction ₹590.

    • TCS (1%) will be deducted from the seller’s payout as per GST law.

    • Listing an item is completely free. You earn only after a successful sale.

    Authentication fee for luxury bags/sneakers: ₹500–₹1,000 (paid by buyer or shared).

    7. Dispute Resolution

    • Disputes between Buyers and Sellers will be reviewed by the Platform.

    • The Platform’s decision shall be final and binding.

    • Users agree not to hold the Platform liable for disputes arising directly between Buyers and Sellers.

      8. Intellectual Property

      • All content, trademarks, and designs on the Platform belong to SWITCH unless stated otherwise.

      • Users may not copy, modify, distribute, or use Platform content without permission.

      9. Limitation of Liability

      • The Platform is a facilitator and does not manufacture, own, or guarantee the products listed.

      • We are not liable for:

        • Quality, authenticity, or legality of Products.

        • Courier delays, damages, or losses in transit.

        • Losses caused by unauthorized account access.

      • The Buyers ought to make informed decisions and are solely liable for the products purchased through SWITCH

      • To the maximum extent permitted by law, our liability is limited to the amount paid by the Buyer for the disputed product.

      10. Termination

      • The Platform may suspend or terminate accounts for violation of these Terms.

      • Users may deactivate their accounts anytime by contacting support.

      11. Governing Law & Jurisdiction

      • These Terms are governed by the laws of India.

      • Any disputes will be subject to the jurisdiction of courts in Hyderabad, Telangana.

      12. Changes to Terms

      • We may update these Terms from time to time.

      • Continued use of the Platform after changes constitutes acceptance of the revised Terms.
